புலித் தடைக்கு எதிராக இந்தியாவில் போராட்டம்!

இந்தியாவில் விடுதலைப்புலிகளுக்கு எதிரான தடையை எதிர்த்தும்  உலக தமிழர் நன்மைக்காகவும்  விரைவில் தமிழர் கட்சி முன்னெடுக்கும்

ஆர்ப்பாட்டம் தொடர்பில் அறிவிக்கப்பட்டுள்ளது 

இந்தியாவின் ஒரு பகுதியை இந்திய யூனியனிலிருந்து பிரிக்க விடுதலைப்புலிகள் முயற்சி செய்வதாக பொய் குற்றச்சாட்டை இந்தியா முன்வைக்கிறது. 

தமிழர்களே!

தமிழர்களுக்கு எதிரான இந்திய அரசின் முகத்திரையை கிழிப்போம்.!

கோரிக்கை :

1... தங்கள் தேச விடுதலைக்காக போராடிய  இயக்கமான விடுதலைப்புலிகளுக்கு எதிரான பொய்யான / கர்பனையான  செய்திகளை கூறி விடுதலைப்புலிகள் இயக்கத்தை தடைசெய்ததை ரத்து செய்.

2.. இந்திய அமைதிப்படை என்ற பெயரில் தமிழீழத்தில்  இந்திய ராணுவம் செய்த கொலைகள், பாலியல் வன்முறைகள் , பொருட்சேதங்கள்  என்ன என்ன என்பது தொடாபான வெள்ளை அறிக்கையை இந்தியா வெளியிட வேண்டும்.

3..கடந்த 1986 முதல் மே 2009 வரை ( முள்ளிவாய்காலில் நடந்த இனப்படுகொலை வரை) இலங்கை அரசிற்கு இந்தியா என்ன என்ன வகையில் ஆயுதங்கள் பயிற்சிகள், பொருளாதார உதவி செய்தது என்பது தொடர்பான வெள்ளை அறிக்கை வெளியிட வேண்டும்.

4.. இலங்கை, மலேசியா, சிங்கப்பூர், தென்ஆப்பிரிக்கா, பிரான்ஸ் போன்ற தமிழர்கள் அதிகம் வாழும் நாடுகளின் வெளியுறவுக்கொள்கையை தமிழக அரசுதான் முடிவு செய்யவேண்டும். அல்லது தமிழக அரசின் ஒப்பதலோடுதான் முடிவெடுக்க வேண்டும்.  

மேற்கூறிய கோரிக்கைகளை  தமிழக தமிழர்களிடம் கொண்டுசெல்லும் நோக்கத்தில் இந்தகோரிக்கை ஆர்ப்பாட்டம் நடைபெறும்    என  அறிவிக்கப்பட்டுள்ளது

NOTIFICATION

New Delhi, the 14th May, 2024

S.O. 1983(E).—WHEREAS the Liberation Tigers of Tamil Eelam (hereinafter referred to as the LTTE), is an association based in Sri Lanka but having its supporters, sympathisers and agents in the territory of India; 

தமிழீழ விடுதலைப் புலிகள் (இனிமேல் LTTE என குறிப்பிடப்படும்) இலங்கையை தளமாகக் கொண்ட ஒரு அமைப்பு , ஆனால் அதன் ஆதரவாளர்கள், அனுதாபிகள் மற்றும் முகவர்கள் இந்தியாவில் உள்ளனர்;

AND WHEREAS the LTTE’s objective for a separate homeland (Tamil Eelam) for all Tamils threatens the sovereignty and territorial integrity of India, and amounts to cession and secession of a part of the territory of India from the Union and thus falls within the ambit of unlawful activities; 

மேலும் அனைத்துத் தமிழர்களுக்கும் தனித் தாயகம் (தமிழீழம்) என்ற விடுதலைப் புலிகளின் நோக்கம் இந்தியாவின் இறையாண்மை மற்றும் பிராந்திய ஒருமைப்பாட்டை அச்சுறுத்துகிறது, மேலும் இந்தியாவின் ஒரு பகுதியை இந்திய யூனியனிலிருந்து பிரிப்பது என்பது  சட்டத்திற்குப் புறம்பான நடவடிக்கையாகும்.

AND WHEREAS, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government declared the LTTE as an unlawful association, vide notification number S.O. 1730(E), dated the 14th May, 2019.(  மேலும், 1967 (1967 of   37) சட்ட விரோத நடவடிக்கைகள் (தடுப்பு) சட்டத்தின் பிரிவு 3 இன் துணைப் பிரிவுகள் (1) மற்றும் (3) மூலம் வழங்கப்பட்ட அதிகாரங்களைப் பயன்படுத்தி, மத்திய அரசு விடுதலைப் புலிகளை ஒரு சட்டவிரோத இயக்கமாக அறிவித்தது. அறிவிப்பு எண் எஸ்.ஓ. 1730(E), 14 மே, 2019 ம் தேதியிட்டது

 AND WHEREAS the Unlawful Activities (Prevention) Tribunal, constituted under section 5 of the Unlawful Activities (Prevention) Act 1967 for the purpose of adjudicating whether or not, after finding that there was sufficient cause for declaring the LTTE as an unlawful association, by its order published, vide notification No. S.O.4233 (E), dated the 21st November, 2019 had confirmed the declaration, so made; தமிழீழ விடுதலைப் புலிகள் சட்டவிரோத இயக்கமாக  பிரகடனப்படுத்துவதற்குப் போதுமான காரணம் உள்ளதா இல்லையா என்பதைத் தீர்ப்பதற்காக, 1967 ஆம் ஆண்டு சட்ட விரோத நடவடிக்கைகள் (தடுப்பு) சட்டத்தின் 5 ஆம் பிரிவின் கீழ் உருவாக்கப்பட்ட சட்டவிரோத நடவடிக்கைகள் (தடுப்பு) தீர்ப்பாயம் விடுதலைப்புலிகள் இயக்கத்தை சட்டவிரோத இயக்கம் என்று  , 21 நவம்பர், 2019 தேதியிட்ட அறிவிப்பு எண். S.O.4233 (E) ஐ உறுதி செய்துள்ளது.

AND WHEREAS the declaration of ban under sub-section (1) of section 6 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) ceases on the 13th May, 2024 ( சட்ட விரோத நடவடிக்கைகள் (தடுப்பு) சட்டம், 1967 (1967 இன் 37) பிரிவு 6 இன் துணைப்பிரிவு (1) இன் கீழ் தடை அறிவிப்பு மே 13, 2024 அன்று முடிவடைகிறது.)

AND WHEREAS the Central Government is of the opinion that LTTE is still indulging in the activities which are prejudicial to the integrity and security of the country, inter-alia, on the following grounds, namely: -

விடுதலைப் புலிகள் தொடர்ந்து இந்திய  நாட்டின் ஒருமைப்பாடு மற்றும் பாதுகாப்பிற்கு பாதகமான நடவடிக்கைகளில் ஈடுபட்டு வருகின்றனர் என்று கீழ்கண்ட காரணங்களால் மத்திய அரசு கருதுகிறது, அதாவது

(i) even after its military defeat in May, 2009 in Sri Lanka, LTTE has not abandoned the concept of ‘Eelam’ and has been clandestinely working towards the ‘Eelam’ cause by undertaking fund raising and propaganda activities and the remnant LTTE leaders or cadres have also initiated efforts to regroup the scattered activists and resurrect the outfit locally and internationally; 

( 2009 மே மாதம் இலங்கையில் இராணுவத் தோல்விக்குப் பிறகும், விடுதலைப் புலிகள் 'ஈழம்' என்ற கருத்தை கைவிடவில்லை, மேலும் 'ஈழம்' பிரச்சினையை நோக்கி இரகசியமாக நிதி திரட்டுதல் மற்றும் பிரச்சார நடவடிக்கைகள் மற்றும் எஞ்சியிருக்கும் புலிகளின் தலைவர்கள் அல்லது பணியாளர்கள் சிதறிய ஆர்வலர்களை மீண்டும் ஒருங்கிணைத்து உள்நாட்டிலும் சர்வதேச அளவிலும் அணியை மீண்டும் எழுப்புவதற்கான முயற்சிகளையும் தொடங்கியுள்ளனர்;)

(ii)  the pro-LTTE groups/elements continue to foster a separatist tendency amongst the masses and enhance the support base for LTTE in India and particularly in Tamil Nadu, which will ultimately have a strong disintegrating influence over the territorial integrity of India; ( புலிகளுக்கு ஆதரவான குழுக்கள்/கூறுகள் மக்கள் மத்தியில் பிரிவினைவாதப் போக்கைத் தொடர்ந்து வளர்த்து, இந்தியாவிலும் குறிப்பாகத் தமிழ்நாட்டிலும் புலிகளுக்கான ஆதரவுத் தளத்தை மேம்படுத்துகின்றன, இது இறுதியில் இந்தியாவின் பிராந்திய ஒருமைப்பாட்டின் மீது வலுவான சிதைந்த செல்வாக்கைக் கொண்டிருக்கும்)

(iii)   the LTTE sympathizers living abroad continue to spread anti-India propaganda among Tamils holding the Government of India responsible for the defeat of the LTTE, which, if not checked, is likely to develop a sense of hate among Tamil Populace towards the Central Government and the Indian Constitution; விடுதலைப் புலிகளின் தோல்விக்கு இந்திய அரசே காரணம் என வெளிநாடுகளில் வாழும் விடுதலைப் புலி அனுதாபிகள் இந்திய எதிர்ப்புப் பிரச்சாரத்தை தமிழர்கள் மத்தியில் தொடர்ந்து பரப்பி வருகின்றனர், அதைத் தடுக்காவிட்டால், மத்திய அரசு , இந்திய அரசியலமைப்பு மீதும், தமிழ் மக்கள் மத்தியில் வெறுப்பு உணர்வு உருவாக வாய்ப்புள்ளது.;

(iv) despite the ban in force, the activities of pro-LTTE organisations and individuals have come to notice and, attempts have been made by these forces to extend their support to the LTTE; 

(விடுதலைப் புலிகளுக்கு எதிரான தடை அமுலில் இருந்த போதிலும், புலிகளுக்கு ஆதரவான அமைப்புக்கள் மற்றும் தனிநபர்களின் செயற்பாடுகள் அவதானிக்கப்பட்டடதில்  அவர்கள் புலிகளுக்கு தமது ஆதரவை வழங்க முயற்சிகள் மேற்கொள்ளப்பட்டுள்ளன.

(v)  the LTTE leaders, operatives and supporters have been inimically opposed to India’s policy on their organisation and action of the State machinery in curbing their activities; (விடுதலைப் புலிகளின்  தலைவர்கள்,  செயற்பாட்டாளர்கள் மற்றும் ஆதரவாளர்கள் அவர்களின் அமைப்பு மற்றும் அவர்களின் நடவடிக்கைகளை கட்டுப்படுத்துவதில் இந்தியஅரசு இயந்திரத்தின் நடவடிக்கை பற்றிய இந்தியாவின் கொள்கையை விரோதமாக எதிர்த்தனர்)

(vi)  cases have been registered under the Unlawful Activities (Prevention) Act 1967, against LTTE, pro-LTTE groups or elements since the last notification published vide number S.O. 1730 (E), dated the 14th May, 2019 which indicate that LTTE and its remnant cadres, followers and supporters are involved in various criminal activities, including smuggling of illegal drugs, arms for furtherance of objective of the LTTE; (1967 ஆம் ஆண்டின் சட்டவிரோத நடவடிக்கைகள் (தடுப்பு) சட்டத்தின் கீழ், LTTE , LTTE சார்பு குழுக்கள் அல்லது தனிநபர்களுக்கு எதிராக வழக்குகள் பதிவு செய்யப்பட்டுள்ளன. 1730 (E), 14 மே, 2019 தேதியிட்ட புலிகள் மற்றும் அதன் எஞ்சிய அங்கத்தவர்கள், பின்பற்றுபவர்கள் மற்றும் ஆதரவாளர்கள் சட்டவிரோத போதைப்பொருள் கடத்தல், விடுதலைப் புலிகளின் நோக்கத்திற்காக ஆயுதங்கள் உள்ளிட்ட பல்வேறு குற்றச் செயல்களில் ஈடுபட்டுள்ளனர்.)

     AND WHEREAS the Central Government is of the opinion that the aforesaid activities of the LTTE continue to pose a threat to, and are detrimental to the sovereignty and territorial integrity of India as also to the public order and, therefore, it should be declared as an unlawful association; (விடுதலைப் புலிகளின் மேற்கூறிய செயற்பாடுகள், இந்தியாவின் இறையாண்மை மற்றும் பிராந்திய ஒருமைப்பாட்டிற்கும், பொது ஒழுங்குக்கும் அச்சுறுத்தலை ஏற்படுத்துவதாகவும், பாதிப்பை ஏற்படுத்துவதாகவும் இருப்பதாக மத்திய அரசு கருதுவதால், அதனை ஒரு சட்டவிரோத அமைப்பாக அறிவிக்ப்படுகிறது.)

 AND WHEREAS the Central Government is further of the opinion that – since LTTE continues – 

(i) with its disruptive, separatist and secessionist activities, which are prejudicial to the integrity and sovereignty of India; and 

(ii)  its strong anti-India posture thereby posing a grave threat to the security of Indian nationals, 

மேலும் மத்திய அரசு தனது கருத்தாக  புலிகள் தொடர்ந்து  

(i) இந்தியாவின் ஒருமைப்பாடு மற்றும் இறையாண்மைக்கு பாதகமான அதன் சீர்குலைக்கும், பிரிவினைவாத மற்றும் பிரிவினைவாத நடவடிக்கைகள்; மற்றும்

(ii) விடுதலைப்புலிகளின் வலுவான இந்திய-விரோத நிலைப்பாடு இந்திய குடிமக்களின் பாதுகாப்பிற்கு பெரும் அச்சுறுத்தலாக உள்ளது

it is necessary to declare LTTE as an unlawful association with immediate effect; 

 எனவே விடுதலைப்புலிகளை சட்ட விரோத அமைப்பாக  உடனடியாக அறிவிக்கப்படுகிறது

NOW, THEREFORE, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Liberation Tigers of Tamil Eelam (the LTTE) as an unlawful association and directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette. 

எனவே, 1967 ஆம் ஆண்டு சட்ட விரோத நடவடிக்கைகள் (தடுப்பு) சட்டத்தின் பிரிவு 3 இன் (1967 இன் 37) துணைப் பிரிவுகள் (1) மற்றும் (3) மூலம் வழங்கப்பட்ட அதிகாரங்களைப் பயன்படுத்தி, மத்திய அரசு இதன் மூலம் விடுதலைப் புலிகள் இயக்கத்தை சட்டவிரோத அமைப்பு  என அறிவிக்கிறது. இந்த அறிவிப்பு, மேற்கூறிய சட்டத்தின் பிரிவு 4 இன் கீழ் செய்யப்படும் எந்தவொரு உத்தரவுக்கும் உட்பட்டு, அதிகாரப்பூர்வ அறிவிப்பு வெளியிடப்பட்ட நாளிலிருந்து ஐந்து ஆண்டுகளுக்கு நடைமுறையில் இருக்கும் என்று அறிவுறுத்துகிறது.
